1. About NIS Training

N.I.S. Compliance & Publications Inc., operating as NIS Training (“NIS,” “we,” “our,” or “us”), provides onsite and online safety and compliance training, certification programs, and related training materials (digital and physical) through its website, learning platforms, and in-person delivery (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms of Service (“Terms”).

2. Scope of Services

The Services include:

  • Onsite (in-person) safety and compliance training programs

  • Online safety and compliance training courses

  • Certification and completion programs

  • Learning management and course delivery

  • Sale of training materials (digital downloads and physical products)

  • Course feedback, surveys, and customer support

Certain Services are delivered through third-party platforms, including a Learning Management System (“LMS”) provider and certificate issuance and credential tracking platforms.

3. Eligibility and Authorized Use

You may use the Services only:

  • For lawful purposes

  • In accordance with these Terms

  • In accordance with any applicable customer, enterprise, or institutional agreement

Where access is provided by an employer, school, or educational agency, use of the Services is subject to that organization’s authorization.

4. Accounts and Security

Some Services (including online programs) require account registration. You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activity conducted under your account

You must notify NIS Training immediately of any unauthorized use or suspected security breach involving your account.

5. Educational and Training Disclaimer

NIS Training provides non-academic, non-credit safety and compliance training delivered through online and onsite programs.

Completion of training may result in certificates of completion but does not constitute academic credit, licensure, or regulatory approval, unless expressly stated in writing.

Training content is provided for informational and compliance purposes only and does not constitute legal, medical, or professional advice. Organizations remain responsible for ensuring compliance with applicable laws, regulations, and site-specific requirements.

6. Store Purchases and Fulfillment

a. Orders

Training materials may be offered for sale through the Services. All purchases are subject to availability and acceptance by NIS Training.

b. Digital Products

Digital products (including downloadable materials and licensed content) are delivered electronically and are non-refundable once access has been granted, except where required by applicable law.

c. Physical Products

Physical training materials may be shipped to the address provided at checkout. Shipping timelines are estimates only and are not guaranteed.

d. Pricing and Errors

Prices may change without notice. NIS Training reserves the right to correct pricing or product description errors and cancel affected orders.

e. Products for NIS Certified Trainers

Certain training materials, instructional resources, and products offered through the Services are intended solely for use by NIS Certified Trainers.

Purchase or access to such materials does not grant authorization to use them for training, certification, or instructional purposes unless the purchaser is an active NIS Certified Trainer or has received prior written authorization from NIS Training.

NIS Training reserves the right to restrict access, revoke licenses, or require proof of certification where applicable.

7. Acceptable Use

You agree not to:

  • Misuse or interfere with the Services

  • Access systems or data without authorization

  • Upload malicious code or attempt to bypass security controls

  • Circumvent licensing or access restrictions

8. Intellectual Property

All training content, materials, trademarks, logos, course resources, and onsite instructional materials are owned by or licensed to NIS Training and are protected by intellectual property laws.

Purchasing training materials or participating in training does not transfer ownership or intellectual property rights.

Use of training materials for instructional or certification purposes is limited to authorized NIS Certified Trainers, unless otherwise approved in writing by NIS Training.

9. User Feedback and Reviews

Users may submit feedback, surveys, or reviews related to onsite or online programs. By submitting feedback, you grant NIS Training a non-exclusive, royalty-free right to use such feedback for service improvement, reporting, and marketing purposes. Feedback must not include sensitive personal or student information.

10. Third-Party Services

NIS Training uses third-party service providers to support delivery of the Services, including a Learning Management System (“LMS”) provider and certificate issuance and credential tracking platforms such as WalletCard.

Not all training programs or certificates are issued or tracked through the same platform. The availability, format, and tracking of certificates may vary by course, delivery method, or customer agreement.

Use of third-party platforms may be subject to additional terms and policies maintained by those providers.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis.
NIS Training makes no guarantee of uninterrupted or error-free operation of online platforms or specific onsite outcomes.

12. Limitation of Liability

To the fullest extent permitted by law, NIS Training shall not be liable for indirect, incidental, special, or consequential damages arising from participation in or use of the Services.

13. Termination

NIS Training may suspend or terminate access to the Services for violations of these Terms or as required by law or contract.

14. Assignment

NIS Training may assign these Terms in connection with a merger, acquisition, sale of assets, or corporate reorganization. Users may not assign these Terms without prior written consent.

15. Survival

Provisions relating to intellectual property, disclaimers, limitation of liability, privacy, data protection, and governing law shall survive termination of these Terms.

16. Governing Law

These Terms are governed by the laws of the Province of British Columbia and applicable federal laws of Canada.

Privacy Policy

This Privacy Policy explains how NIS Training collects, uses, protects, and discloses personal information in connection with onsite and online training services and store purchases.

2. Categories of Information We Collect

a. Training and Certification Data

  • Name

  • Email address

  • Course enrollment and completion status

  • Certificates issued

  • Post-course survey responses

b. Store and Order Information

  • Name

  • Email address

  • Shipping address (for physical products)

  • Order history

Payment information is processed by third-party payment processors. NIS Training does not store credit card information.

c. Optional Profile Information

Optional fields (such as phone number) may be provided but are not required to access training services.

3. How We Use Information

Information is used to:

  • Deliver training and certification services

  • Fulfill orders and deliver purchased materials

  • Communicate about accounts, courses, and orders

  • Improve course quality through feedback

  • Comply with legal and contractual obligations

NIS Training does not sell personal information and does not use personal or student information for targeted advertising, profiling, or marketing analytics.

4. Educational Data & Student Privacy

When providing services to schools or educational institutions:

  • Student data is processed solely on behalf of the institution

  • Data use is limited to authorized educational purposes

  • Practices align with FERPA, applicable state education laws, and contractual obligations

  • Student data is not used for marketing or advertising

5. Children’s Privacy (COPPA)

Student information may be provided by schools or educational agencies in accordance with applicable law, including FERPA and COPPA. NIS Training does not knowingly collect personal information directly from children outside authorized educational contexts.

6. Cookies and Technical Data

Cookies and similar technologies may be used to:

  • Support secure authentication and session management

  • Enable store checkout and fraud prevention

  • Support LMS functionality

These technologies are not used for behavioral advertising.

7. Data Security

NIS Training maintains administrative, technical, and organizational safeguards designed to protect personal information.

Technical security controls are supported by third-party platforms, including:

  • DigitalChalk (learning management system)

  • WalletCard (certificate issuance and credential tracking)

These providers operate under their own security and privacy controls and contractual confidentiality obligations.

NIS Training’s security practices materially align with the NIST Cybersecurity Framework.

8. Data Retention

Personal information is retained only as long as necessary to:

  • Deliver training and fulfill orders

  • Meet contractual and legal obligations

Data is securely deleted or anonymized when no longer required.

9. Data Breach Notification

In the event of a data security incident involving personal information, NIS Training will notify affected customers and educational agencies in accordance with applicable law and contractual requirements.

10. Third-Party Disclosures

Information may be shared with trusted service providers (such as LMS providers, certificate platforms, payment processors, and shipping partners) subject to confidentiality and security obligations. NIS Training does not sell personal information.

11. Policy Updates

Changes to this Privacy Policy will be posted with an updated effective date. Material changes may be communicated through the website or account notifications where appropriate.

Returns & Refund Policy

1. Scope

This policy applies to the purchase of training materials, including digital products and physical goods, sold by NIS Training.

2. Digital Products

Due to the nature of digital content:

  • All sales are final once access has been granted

  • No refunds or returns are provided, except where required by law

3. Training Courses

Enrollment in online or onsite training courses and certification programs is non-refundable once access has been granted or training has commenced, unless otherwise expressly stated in writing or required by law.

4. Physical Products

a. Eligibility

Returns are accepted only if:

  • The product arrives damaged or defective, or

  • An incorrect item was shipped

Requests must be made within 24 hours of receipt.

b. Return Process

To request a return:

  • Email info@nistraining.com

  • Include the order number

  • Include a photo of the damage or defect (if applicable)

NIS Training reserves the right to determine eligibility.

c. Exclusions

Returns are not accepted for:

  • Customer ordering errors

  • Normal wear and tear

  • Unauthorized returns

A restocking fee may apply where permitted.

5. Refund Method

Approved refunds or replacements will be issued at NIS Training’s discretion and refunded to the original payment method where applicable.

6. Shipping and Delivery

Shipping timelines are estimates only. NIS Training is not responsible for carrier delays or external factors beyond its control.

7. School and Institutional Purchases

For purchases made under a school district, institutional, or enterprise agreement, return and refund terms may be governed by the applicable contract and may supersede this policy.
